To Trademark Or Not To Trademark

I don't know how many of you have heard, but the Dervaes family in Pasadena, California of Path To Freedom fame, whom I greatly admire for their accomplishments, have trademarked several phrases, 2 of which are "urban homestead" and "urban homesteading." In addition to trademarking the phrases, they have begun to send out Cease and Desist letters to blog owners, non-profit organizations, for-profit businesses, etc. that use those phrases in their titles, asking them to change their names, and, yesterday, they had Facebook take down every page that used the phrase "urban homesteading" in its page name.

Needless to say, this has caused quite a stir in the urban homesteading community. I think it's safe to say that they have outraged a large portion of their fan base.

Some facts. While the Dervaes Institute trademarked the phrase "urban homesteading," the trademark examiner only allowed it to be put on what's called the Supplemental Register. While this is still a trademark, it is a much weaker trademark than that found on the Principal Register because it means the Federal Trademark Office doubts that it will hold up in court (my words, not theirs). The examiner even commented on the fact that urban homesteading is a way of life, not an entity to trademark. It means that the term can still be used by anyone and the Dervaes Institute will have to decide if they think it's worth it to attempt to enforce it in court. To enforce it, they would have to prove that they are synonymous with the phrase--that when someone uses the words "urban homesteading," they immediately think of the Dervaes family.

My thoughts on the matter. I think what they should have trademarked was the phrase "Path To Freedom Urban Homestead." That's it. That's what we all know them as. They claim on their website that they did it to protect the term, that they felt that some people were abusing it just to make money. If this is the reason they did it, why then would they ask urban homesteading bloggers and non-profits to take down their blogs and websites? Why would they have Facebook take down the pages of the people who are living and teaching the lifestyle Path To Freedom promotes? In their own words, taken from a blog post from Anais yesterday:

"We are a nonprofit group that has promoted urban homesteading and asked that people use our urban homestead example in their own lives.  However, as with most any book and/or publication, and as stated on the bottom of all our websites, the information and content contained on our online book is copyrighted."
So what exactly is it that the Dervaes family does differently? Are their raised beds different from mine or anyone else's? Did they create organic gardening? Do they plant seeds differently? What exactly is it that they are claiming ownership of?

So what do you think about this?

I think it's pretty ridiculous and I wrote them an email saying so. I really value what they have contributed to the urban homesteading movement, but hey- it's a movement. They are not the only ones gardening in the city!

It is a shame is what it is. I had no idea who they were until I read THIS Post. I have heard of them before, but the name(s) did not stick at all. Good luck to all the people they are going to harrass over this. Sad.

Thanks for this review. It is so unfortunate. They have provided such a fabulous example to the rest of us of what can be accomplished, but their actions are fracturing the urban homesteading community and turning people against them.

I think I will trademark the phrases windowsill gardening and container gardening. Give me a break! Where does the nonsense stop? It is really disheartening when people's heads get too big once they get a following. I won't be following them any more.

I hope when the courts rule against them, they have to pay restitution to all the organizations and blog owners that were forced to Cease and Desist!

Hey thanks for a more complete discussion of the Dervaes issues. I heard bits and pieces. Since I grew up in Oklahoma with the land run and homesteading I was surprised that the term "urban homestead" could be trademarked.

I've got a new to me 2/3 acre city lot so I'm trying to layout my veggie raised beds and fruit bearing trees/vines. Found you through google.

I'm outraged that they did this. I never heard of them before this trademark thing came up. Maybe I should trademark "vegetable garden" since my website-- Grow-YOUR-Vegetable-Garden.com --uses that term and I don't want anyone abusing vegetables!

Wow, I am getting caught up on all my friend's blogs and am reading up on yours now. This is amazing... I could have easily been told my blog is violating their "ownership" of the term urban homestead. That's crazy! How sad... I have posted their videos on my Facebook page and I think on my blog too. I'm not very inspired by their attitudes now!

Mary - a quick update. This week, 2 groups have now filed petitions to legally have the trademarks canceled for "urban homestead" and "urban homesteading." One is a publishing company and the other is the Denver Urban Homesteading group whose Facebook page was taken down without notice. From my reading of their petitions, I am 99.99% sure that the Dervaes' will be defeated. The petitions proved that these phrases are common and certainly occurred in published works for many years before the Dervaes family homestead ever became established in Pasadena.

I'm sure it will not be a quick process as it was not a quick process (it took several years) for the Dervaes' to get the trademarks in the first place, but I'm certain the trademarks (especially "urban homesteading") will be canceled and we can all smile again.

If there was something good to come out of this controversy, it's that the urban homesteading community has banded together and gotten quite solidified. For that, I thank the Dervaes family.
